Terms and conditions for advertisers
The terms under which you can order publications through Comunicate.eu: what we commit to, what is expected of you, how payment works, and what happens if a publication cannot be delivered.
Version 2.0 · in force from 06.09.2026
Updated on 6 October 2026.
This is a translation of the Romanian text, provided for convenience. In case of any difference of meaning, the Romanian version prevails, as the language in which the contract is concluded.
What the platform does
Comunicate.eu arranges the publication of advertising articles (advertorials) on websites run by third parties or by ARC MEDIASOFT SRL. You order a publication, we pass it to the site you chose, and the article appears there.
Advertising labels
Romanian Law 363/2007, Annex 1 point 11, classes it as an unfair commercial practice in every case to use editorial context to promote a product that has been paid for without saying so clearly, in a form the reader can easily identify.
The label is each publication's own decision, as the editor of its site. Some put "(P)" or "Advertorial" in the title, others a note at the end of the article or a dedicated category, others do not label at all. What each one chose is written in the catalogue, next to the price, so you see it before you order. We pass the article on as you wrote it; we neither add nor remove any label.
Responsibility for unlabelled advertising rests with everyone involved, including you as the party being promoted. The publication's choice is shown precisely so the decision is yours, made knowingly.
Your content
It stays yours. You grant us the right to transmit and publish it on the sites you choose. You warrant that you have the right to publish it and that it infringes nobody's copyright, trade mark or image rights.
We do not accept illegal content, or content about tobacco (including electronic cigarettes and accessories), gambling without an ONJN licence, or weapons, nor misleading advertising, which includes phrases such as "the best" with no verifiable basis.
Political advertising
We do not publish political advertising within the meaning of Article 3, point (2), of Regulation (EU) 2024/900 on the transparency and targeting of political advertising, whether paid or free. In short, this means messages by or on behalf of a party, a candidate or another political actor, unless they are of a purely private or purely commercial nature, and messages designed to influence the outcome of an election or referendum, voting behaviour or a legislative or regulatory process.
The Regulation requires us to ask you, for every publication you order, whether it is a political advertising service (Article 7(1)). Sending an order stands as your declaration that the publication requested is not a political advertising service within the meaning of Article 3, point (5), of the Regulation. You make the declaration truthfully and are responsible for its accuracy. If the publication would be political advertising, do not send the order.
We reject orders that are manifestly political advertising. If we learn after publication that a piece is political advertising, we may remove it from the site.
Prices and payments
All displayed prices are excluding VAT. VAT is added on the invoice, at the statutory rate in force on the date of issue. Topping up the account is invoiced at the moment of payment; publications are deducted from the available balance, at the site's net price at the time of the order.
What we guarantee and what we do not
We guarantee that we transmit the article to the chosen site and that we tell you if publication failed. We do not guarantee search engine positions, traffic, indexing or that the article stays up indefinitely: the sites belong to third parties, and their editorial decisions are not ours.
If a publication fails through our fault or the site's, the amount is returned to your balance.
Changing and deleting published articles
Both can be requested from the platform. Every request goes through an administrator's approval, whatever the circumstances, because a change on somebody else's site is not made automatically.
Liability
Our liability is limited to the amount paid for the publication in question, except for damage caused intentionally or through gross negligence, for which liability cannot be limited (art. 1355(1) of the Romanian Civil Code). We are not liable for indirect losses or lost profit.
Termination
You may close your account at any time. Unspent amounts are refunded on request, less any fees already withheld by the payment provider. Publications already carried out remain carried out.
Changes to these terms
When we change these terms, we publish a new version and show it to you in the app before it takes effect for your account. The new version applies only once you accept it, and only to orders sent from then on. Orders sent earlier stay under the version in force on the date of the order.
Governing law
This contract is governed by Romanian law. Disputes are settled by the courts having jurisdiction at the registered office of ARC MEDIASOFT SRL, if no agreement is reached.
Clauses accepted expressly
Some clauses of these terms are among those for which art. 1203 of the Romanian Civil Code requires express acceptance in writing:
- the limitation of our liability, in the "Liability" section; - our right to reject orders and to remove pieces, in the "Political advertising" section; - the governing law and the competent court, in the "Governing law" section.
The terms are accepted in the app: we make the full text available, including this section (the “Read the text” button), and you tick "I have read and accept" next to them. By this tick you also expressly accept the clauses above. If you do not agree with them, do not tick and write to us at contact@comunicate.eu.
